Terms of service for Kajakowa Rospuda

1 General Provisions

To ensure that the rules of cooperation with our company are clear and transparent, we have drawn up regulations containing basic information about the services we provide. Please read them and follow the recommendations contained therein.

The rental does not organize kayak trips — it only provides and rents kayaks and floating equipment for trips. The organizer of the kayak trip is exclusively the person submitting the equipment reservation request.

The trip organizer is fully responsible for the rented equipment from the moment of pickup to return, regardless of who actually uses the kayaks during the trip.

2 Rental Conditions

In the event of damage, loss or theft of equipment, the organizer is obliged to return its equivalent at 100% of the market price at the time of reporting, regardless of the degree of depreciation of the equipment.

Sample prices of equipment most often lost or damaged: aluminum paddle — PLN 160, life jacket — PLN 100, seat in a single kayak — PLN 450, polyethylene kayak Roteko/Aquarius — PLN 2500.

Before starting the trip, the organizer is obliged to check the technical and quantitative condition of the rented equipment and report any comments to the person issuing the equipment. Each time, the organizer will confirm in writing or orally the quantity of equipment collected, thereby assuming material responsibility for it.

The organizer is obliged to take care of the entrusted equipment throughout the entire trip, secure it against damage, theft or loss, and use it in accordance with its purpose and instructions.

3 Liability and Safety

Kayak rental fees are collected in advance, before the start of the trip. A fee is also charged in the event of resignation from the ordered part of the equipment on the day of the trip or during the trip, unless it is caused by a weather breakdown preventing safe continuation.

Equipment reservation is made on the basis of an advance payment of the specified amount of costs resulting from the offer, which must be paid at least 7 days before the date of service implementation, unless other individual arrangements have been made. The remaining amount must be paid on the day of equipment pickup.

In the event of participation of minors in organized kayak trips, the trip organizer is obliged to obtain consent for the minor's participation from the legal guardian and bears full responsibility for their safety and behavior on the route.

The rental reserves the right to refuse to issue equipment if it is noticed that the trip participants are under the influence of alcohol or other intoxicating substances — without refund of costs incurred by these persons. In the event of alcohol intoxication during the trip, the participant ends the trip at the place where it occurred, incurring additional transport costs to the base.

4 Reservations and Payments

During the trip, one should behave in accordance with the good customs of a waterman and the safety of the participants. It is forbidden to make noise and litter the water area and banks, sit on the gunwale, bow, stern or in a kayak not on the water, stand and crouch in the kayak, jump from the kayak into the water, or sit on life jackets.

The rental representative is obliged to provide the trip participants with information about all the conditions under which the trip takes place, and above all: rules for using floating and safety equipment, selection of sections in terms of fitness and skills, and information about the kayak route and stopping places.

Earlier than agreed dates, places and times of ending the trips must be accepted by the rental. The organizer cannot arbitrarily change the trip plan without agreement with the staff.

We do not bear any responsibility for the behavior of participants during the trip, and in particular for damage they may cause to other persons or companies. The person renting the kayaks, i.e. the trip organizer, is solely responsible for the safety of the group and order on the route.

5 Equipment Return

We do not bear any responsibility for accidents, loss of health or death of trip participants. Each participant takes part in the trip at their own risk, and the trip organizer is responsible for the safety of the group.

We are not responsible for damage to cars left by trip participants in an unguarded parking lot, and in particular for theft, damage, vandalism including damage caused by forces of nature.

The rental is not responsible for delays, route changes or interruption of the trip resulting from weather conditions, low water level, force majeure or other circumstances beyond the rental's control.

6 Final Provisions

Any dispute arising in connection with the service contract with the rental will first be resolved amicably. In the absence of agreement, disputes will be decided by the court competent for the rental's registered office.

Equipment reservation in the form of a written contract or verbal agreement is unequivocal with the acceptance of the above conditions and obliges the organizer to comply with them throughout the duration of the trip.

Matters not regulated by these regulations are governed by the provisions of the Civil Code and the law on tourist services.
